Naturalization denied: what to do?
Feb 18, 2026
If you received a denial for your Brazilian naturalization application, the first thing you need to know is: this does not mean you have lost your right to citizenship.
A denial may concern an unmet legal condition or insufficient supporting documentation. Check the decision and the case file to establish the specific reason.
Documentation points to check:
• Lack of proof of Portuguese language proficiency; • Expired or incomplete certificates; • Issues with proof of residence; • Discrepancy of names between documents; • Absence of criminal background from the country of origin.
Article 65 of Law 13.445/2017 sets the conditions for ordinary naturalization: civil capacity under Brazilian law, the required period of residence in Brazil, communication in Portuguese taking the applicant’s circumstances into account, and no criminal conviction or legal rehabilitation. If the decision cites this article, check which condition was found unmet and the documents supporting that conclusion.
After the denial, you have two options:
• File an administrative appeal; • Correct the pending issue and submit a new application.
The choice between an appeal and a new application depends on the reasons for the decision and the status of the case. A new application is not guaranteed to be faster. Before deciding, check the appeal deadline and the conditions for a new application.
Can I apply again after a denial?

A refusal that is upheld does not prevent a new application if the objective conditions for naturalization are met, as expressly provided by Article 232 § 2 of Decreto 9.199/2017.
That provision sets no separate waiting period for a new application. Reapplication and appeal are different procedures: the appeal deadline is ten days from receipt of the refusal notification. Before applying again, check the reasons for refusal, compliance with the conditions and the status of the earlier case to avoid duplicating an application that is still under review.
Before reapplying, it is important to:
• Understand the reason for the denial; • Verify that all documents are up to date; • Ensure that legal requirements have been met.
Submitting a new application without correcting the previous error can result in another denial. Therefore, a careful analysis of the previous process is essential before starting a new submission.
