Naturalization with a Brazilian child: when the residence requirement can fall to 1 year
Feb 10, 2026
Many people believe they need to live in Brazil for 4 years to apply for citizenship. But this is not true in all cases.
If you have permanent residence and have a Brazilian child, the minimum period of residence can be reduced to just 1 year. This possibility is provided for in Brazilian migration legislation and is quite common in naturalization processes.
To apply for citizenship in this modality, you must:
• Have indefinite residence authorization; • Prove ties to the Brazilian child; • Demonstrate residence in Brazil for at least 1 year.
One year is the minimum residence period for this ground, not a deadline for obtaining citizenship. The other ordinary naturalization conditions still apply, including civil capacity, communication in Portuguese, and no criminal conviction or legal rehabilitation (Articles 65 and 66 II of Law 13.445/2017).
The tie does not need to be formalized by marriage. The existence of a Brazilian child is already considered a factor of integration into Brazilian society.
Parentage and the required period of residence must be documented in accordance with the rules applicable to the application.
